Documentary Evidence

Documentary evidence refers to any document or written item, including digitally stored documents. Documentary evidence can be recorded on any material. For example, text messages between the accused and victim in a sexual assault trial that are relevant to the alleged assault are an example of documentary evidence.

Documentary evidence includes but is not limited to:

• Text messages, direct messages on social media, and emails
• Breathalyzer and toxicology results
• Sexual assault evidence kits
• Electronic Documents and Computer data
• Reports or records
